Agreement to Terms
By requesting services from Albert's Road Service LLC ("we," "us," "our," or "Company"), or by using our website at albertsroadservice.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or website. These terms apply to all customers, visitors, and anyone who engages with our business.
Services
Albert's Road Service LLC provides mobile diesel truck and trailer repair, preventive maintenance, DOT inspection services, and related mechanical services throughout Palm Beach County, Broward County, and the Treasure Coast region of Florida.
We operate as a mobile repair service. Repairs are performed at the customer's location, including roadsides, truck stops, loading docks, parking lots, and yards. Not all repairs can be performed in a mobile setting. If a repair requires shop equipment or facilities, we will advise you and help coordinate next steps.
Service Estimates and Authorization
We provide verbal or written estimates before beginning work whenever possible. Estimates are based on initial diagnosis and may change if additional problems are discovered during the repair process. We will notify you and obtain authorization before proceeding with any work that exceeds the original estimate by a material amount.
By requesting service and authorizing work (verbally, by text, email, or in person), you agree to pay for all authorized repairs, parts, and labor charges. Authorization may come from the vehicle owner, fleet manager, driver, dispatcher, or any person with apparent authority over the vehicle.
Pricing and Payment
Our pricing includes a service call fee (which varies by location and time of day), labor charges billed by the hour, and the cost of parts and materials. After-hours, weekend, and holiday service may be billed at higher rates than standard business hours.
Payment is due upon completion of service unless other arrangements have been made in advance. We accept cash, all major credit and debit cards, fleet checks, Comchek, T-Chek, and EFS. Net-30 invoicing is available for established fleet accounts with approved credit.
If payment is not received when due, a late fee of 1.5% per month (18% annually) may be applied to the unpaid balance. Customer is responsible for all collection costs, including reasonable attorney's fees, if collection action becomes necessary.
Warranty
Albert's Road Service stands behind its work. We provide a limited warranty on labor and parts as follows:
- Labor: We warrant our workmanship for 30 days or 10,000 miles (whichever comes first) from the date of service. If a repair we performed fails within this period due to our workmanship, we will re-perform the repair at no additional labor charge.
- Parts: Parts are covered by the manufacturer's warranty. Warranty periods vary by part and manufacturer. We will assist with warranty claims for parts we supplied and installed.
This warranty does not cover failures caused by abuse, neglect, improper operation, accidents, modifications by others, or normal wear and tear. This warranty does not apply to customer-supplied parts.
Limitation of Liability
To the fullest extent permitted by Florida law, Albert's Road Service LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of cargo, loss of business opportunities, or costs of substitute transportation, arising out of or related to our services.
Our total liability for any claim related to services performed shall not exceed the total amount paid by the customer for the specific service in question. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
We are not liable for delays in service caused by weather, traffic, parts availability, or other circumstances beyond our reasonable control. While we strive to meet estimated response times, they are not guaranteed.
Customer Responsibilities
By using our services, you agree to:
- Provide accurate information about the vehicle, the problem, and your location
- Ensure the vehicle is in a reasonably safe and accessible location for our technician to work
- Disclose any known hazards, hazardous materials, or safety concerns related to the vehicle or its cargo
- Remove personal property and valuables from the immediate work area
- Provide timely payment as agreed upon
- Notify us promptly of any concerns about completed work
Safety and Roadside Work
Mobile and roadside repair work inherently involves risk. Our technicians follow safety best practices, including the use of warning triangles, reflective gear, and proper positioning. However, the customer acknowledges that roadside repairs take place in potentially hazardous environments (active roadways, shoulders, loading docks, etc.). Albert's Road Service is not liable for incidents or injuries caused by third parties (such as passing motorists) during roadside service calls.
Incomplete Repairs and Abandoned Vehicles
If a customer authorizes a repair but fails to pay upon completion, or abandons a vehicle during a repair, Albert's Road Service reserves the right to exercise a mechanic's lien under Florida Statutes Chapter 713. We will make reasonable efforts to contact the vehicle owner before pursuing any lien.
Indemnification
You agree to indemnify, defend, and hold harmless Albert's Road Service LLC, its owner, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of our services, your violation of these terms, or any inaccurate information you provide to us.
Website Use
The content on our website is provided for general informational purposes only. While we strive to keep information accurate and up to date, we make no warranties about the completeness, reliability, or accuracy of the website content.
You may not use our website for any unlawful purpose, attempt to gain unauthorized access to our systems, or use automated tools to scrape or copy website content without permission.
Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Albert's Road Service LLC or its content suppliers and is protected by United States copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
Governing Law and Disputes
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising out of or related to these terms or our services shall be resolved in the courts of Palm Beach County, Florida. Both parties consent to the exclusive jurisdiction of such courts.
Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of our services or website after changes are posted constitutes acceptance of the revised terms.
